Il 31 gennaio l’Autorité de la concurrence ha emesso un provvedimento cautelare nei confronti di Google per presunto abuso di posizione dominante nel mercato della pubblicità online. Il procedimento sorge dalla denuncia della società di digital advertising Amadeus, la quale si sarebbe vista sospendere improvvisamente la fornitura dei servizi Google Ads senza valide motivazioni. In ragione della posizione detenuta da Google nel mercato dell’online advertising (con una quota del 90% in Francia), l’interruzione della partnership ha determinato per Amadeus un calo del fatturato del 90% tra il 2017 e il 2018.

Today the German Competition Authority has imposed on Facebook restrictions in the processing of user data. The Authority’s decision covers different data sources: Facebook-owned services like WhatsApp and Instagram and third party websites.

The Bundeskartellamt has informed Facebook of its preliminary legal assessment in the abuse of dominance proceeding which the Authority is conducting against the company.

Based on the current stage of the proceedings, the Authority assumes that Facebook is dominant on the German market for social networks. The Authority holds the view that Facebook is abusing this dominant position by making the use of its social network conditional on its being allowed to limitlessly amass every kind of data generated by using third-party websites and merge it with the user's Facebook account.

The European Commission published today a proposal for a Directive to empower EU National Competition Authorities (NCAs) to be more effective enforcers when prosecuting anticompetitive conducts by the undertakings pursuant to Articles 101 and 102 TFEU and correspondent national provisions.

Among the shortcomings tackled by the Proposal, the European Commission underlines that currently “the majority of NCAs cannot notify key enforcement measures or request the enforcement of their fines cross-border if the infringer has no legal presence in their territory. Such companies currently have a safe haven from paying the fine”.
